Key Details of Partially Revised「Rules for Collection of Official Patent Fees, etc.」(effective from August 1, 2023)

□ Reduction of patent registration fee

(Details) The basic fee and the additional fee per one claim will be reduced for the entire range of patent registration fee (no distinction between subjects)

(Enforcement) The fee for establishment of rights applies from the case where the registration decision date is August 1, 2023, and the annuity fee applies from the case where the payment date (within the normal payment period) is August 1, 2023.

□ Adjustment of fee for transfer of rights

(Details) The registration fee for the transfer of patent rights and trademark rights will be reduced to KRW 40,000, in the same manner as the amount of utility model rights and design rights, which is the minimum amount

(Enforcement) To be applied from the application for the transfer registration as of August 1, 2023

□ Reduction of trademark fees and adjustment of additional fee imposition criterion for designated goods 

(Adjustment of fees) The current fees for trademarks at the phase of application and remigration will be reduced by KRW 10,000. 

- (Target) Fees associated with application and registration of trademarks‧ additional registration and application of designated goods (relevant amendment fees), request for re-examination, registration for establishment of rights (including installments), registration of additional designated goods, and registration for renewal of duration (including installments)

(Adjustment of imposition criteria of additional fees) The number of designated goods per class over which an additional fee is to be imposed will be changed from current 20 to 10. 

- (Target) This adjustment will be applied to additional fees to be imposed to designated goods related to trademarks across the board

 * The additional fee per designated goods to be added remains the same as KRW 2,000 (KRW 1,000 for installment).

□ Introduction of additional fee structure for divisional applications

(Details) Additional fee structure (one time to maximum five times of the official filing fee of a new patent application) for the number of divisional patent applications will be introduced. 

(Enforcement) This change will be effective from August 1, 2023, regardless of the number of previous divisional patent applications

□ Adjustment of number of exemption of exemption objects

(Details) The number of exemptions will be changed to five cases per annum by rights (patent ‧ utility model ‧ design)

(Enforcement) The change will apply to patent applications filed on January 1, 2024.

□ Increase in the official fee for Request for Examination

(Details) The basic fee and additional fee per claim will be partially raised.

(Enforcement) The change will apply to patent applications filed on or after August 1, 2023.
